🗞 TL;DR - User-generated content (UGC) is a great way to reach new audiences with authentic content, build trust with your community, and optimize your team’s efforts. But if you decide to use UGC, you'll want to make sure you’re using it legally unless you’re okay risking blowback (no hate, but you shouldn’t be okay with this).
💡 Insight - The actual legality around reposting UGC can be a bit of a grey area depending on specifics like platform or country, but here are the four key rules to legally resharing UGC:
Understand the legalities and responsibilities brands have when it comes to reposting UGC. The main concern is that the original poster of an image or video owns the copyright and ownership rights to it, which means they have the right to any revenue or benefits created by that piece of content.
Always ask for permission either with a DM to the creator or via confirmation on a branded hashtag submission. This direct approach makes it more likely that a creator is willing to let you use their UGC free of charge without repercussions.
Make sure to correctly credit the creator by tagging the creator in the image and in the caption. Again, making sure the mention of the OG creator’s profile is easily visible makes it less likely that the creator will come back to you with complaints later.
In some content, a repost might be better. For example, reposting the original IG post to your IG Story or reposting a Threads/X/Bluesky text post might offer more impact than you posting them content natively yourself. This also allows the creator’s page to be featured, which goes around any need to ask for permission or worry about repercussions.
